KIDNAPPING CASE oVERVIEW

A person commits the offense of kidnapping when he or she secretly confines another against his or her will by force, or

by threat of force, carries another person from one place to another with intent to secretly confine him against his or her will, or by deceit induces someone to go from one place to another with the intent to secretly confine.

Aggravated Kidnapping

Aggravated Kidnapping involves the elements above, plus

  • if the kidnapping is committed for the purpose of obtaining ransom, or

  • if the victim is under the age of 13 or mentally disabled, or

  • if great bodily harm is inflicted, or

  • if another felony is committed upon the victim, or

  • if the offender wears anything to conceal his identity, or

  • if the offender commits the offense with a fire arm.

Penalty

  • Kidnapping is a Class 2 felony. The sentence range is 3-7 years in the Illinois Department of Corrections.

  • Aggravated Kidnapping is a class X felony. The sentence range is 6-30 years in the Illinois Department of Corrections.
